Summary: These Terms of Service ("Terms") govern your use of ServiceCall.com. By using our service, you agree to these terms. Please read them carefully.
1. Agreement to Terms
By accessing or using ServiceCall.com ("Service"), you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms, you may not access the Service.
BY USING THE SERVICE, YOU SPECIFICALLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY SECTION 10 (DATA ENRICHMENT SERVICES DISCLAIMER) AND SECTION 11 (LIMITATION OF LIABILITY), INCLUDING ALL DISCLAIMERS REGARDING DATA ACCURACY AND THE LIMITATIONS ON OUR LIABILITY.
2. Description of Service
ServiceCall.com provides lead enrichment services for contractors. Our Service:
- Integrates with your existing CRM system
- Automatically enriches leads with property data, home equity estimates, permit history, energy savings projections, and rebate eligibility
- Writes enriched data back to your CRM
Important: ServiceCall.com does NOT generate, provide, or sell leads. We only enrich leads that already exist in your CRM.
3. User Accounts
To use the Service, you must:
- Create an account with accurate information
- Be at least 18 years old
- Have authority to bind your company to these Terms
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
You are responsible for all activities under your account.
4. Payment Terms
- Pricing is as displayed on our website at time of purchase
- Subscriptions are billed monthly or annually, based on your selection
- Payment is due at the beginning of each billing period
- All fees are non-refundable
- We may change pricing with 30 days notice
Plan Changes
- Upgrades take effect immediately and are prorated
- Downgrades take effect at the next billing cycle
- Changes from annual to monthly plans take effect at annual renewal
5. Free Trial
- New users receive a 15-day free trial
- No credit card required to start trial
- Trial includes full access to Service features
- Trial is limited to 50 enriched leads
- After trial, subscription is required to continue
6. Service Availability
We strive to maintain high availability and target 99% monthly uptime. However, the Service may be temporarily unavailable due to:
- Scheduled maintenance (with advance notice when possible)
- Emergency repairs
- Circumstances beyond our control
If we fail to meet our uptime commitment, you may be eligible for service credits. Contact our support team to request an SLA credit assessment.
7. Intellectual Property
The Service, including its design, code, features, and content, is owned by ServiceCall Inc. and protected by intellectual property laws. You may not:
- Copy, modify, or distribute our Service
- Reverse engineer or decompile our software
- Use our trademarks without permission
- Resell or redistribute our Service
8. User Content
You retain ownership of data you provide. By using the Service, you grant us a limited license to access your CRM data solely to provide the enrichment service.
9. Prohibited Uses
You may not use the Service to:
- Violate any laws or regulations
- Infringe on others' intellectual property
- Transmit malware or harmful code
- Attempt to gain unauthorized access
- Interfere with Service operation
- Use for any purpose other than intended business use
10. Data Enrichment Services Disclaimer
ServiceCall.com provides estimated property data and analytics derived from third-party sources and proprietary algorithms. You acknowledge and agree to the following:
10.1 Nature of Data Services
- Property value estimates are NOT professional appraisals and should not be relied upon as such. They are automated valuation model (AVM) estimates only.
- Home equity calculations are estimates based on publicly available data and algorithms, not actual mortgage records or title searches.
- Permit history depends on county records availability and may be incomplete, outdated, or unavailable for certain jurisdictions.
- System age estimates (HVAC, water heater, roof, etc.) are derived from permit data and may not reflect actual equipment installation dates or current condition.
10.2 AI-Powered Features Disclaimer
ServiceCall.com uses artificial intelligence and machine learning for certain features, including Max Qualifier lead scoring. You acknowledge that:
- Lead scores (0-100 scale) are probabilistic assessments, not guarantees of customer conversion or project value.
- AI predictions are based on historical patterns and statistical models that may not accurately predict future outcomes.
- Scores should be one factor among many in your business decisions, not the sole basis for action.
- AI models are continuously refined and scores may change over time even for the same property.
10.3 Rebate and Incentive Information
Rebate eligibility information provided by ServiceCall.com is for informational purposes only:
- Rebate programs change frequently and information displayed may be outdated at any time.
- Final eligibility is determined solely by the rebate program administrator, not by ServiceCall.com.
- We are not responsible for changes to, termination of, or denial by any rebate or incentive program.
- Energy savings projections are estimates and actual savings will vary based on many factors outside our control.
10.4 Address Matching and Data Association
ServiceCall.com uses address matching algorithms to associate property data with leads in your CRM. You acknowledge that:
- Address matching is not guaranteed to be accurate.
- Data may be associated with the wrong property in some cases, particularly for partial, incomplete, or non-standard addresses.
- You are responsible for verifying data accuracy before making any business decisions based on enriched data.
10.5 Third-Party Data Sources
Much of the data provided by ServiceCall.com originates from third-party sources. We do not control and are not responsible for:
- The accuracy, completeness, reliability, or timeliness of third-party data
- Errors, omissions, or delays in third-party data
- Third-party data source availability, discontinuation, or changes in coverage
- Any actions taken by you or others based on third-party data
10.6 No Reliance for Financial or Legal Decisions
Data provided by ServiceCall.com should NOT be used as the sole basis for:
- Loan or financing decisions
- Investment decisions
- Property valuations for legal, tax, or insurance purposes
- Insurance coverage determinations
- Any other financial, legal, or regulatory decisions requiring certified or appraised data
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
a) WARRANTY DISCLAIMER
ServiceCall.com is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, title, and non-infringement.
b) DATA ACCURACY DISCLAIMER
WE EXPRESSLY DISCLAIM ANY WARRANTY OR REPRESENTATION REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, CURRENTNESS, OR TIMELINESS OF ANY DATA PROVIDED THROUGH THE SERVICE, including but not limited to property values, home equity estimates, permit data, system ages, rebate information, energy savings projections, lead scores, and any other enrichment data.
c) CONSEQUENTIAL DAMAGES
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
d) MAXIMUM LIABILITY
OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (I) THE AMOUNTS ACTUALLY PAID BY YOU TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (II) ONE HUNDRED DOLLARS ($100 USD).
e) THIRD-PARTY ACTIONS
WE ARE NOT LIABLE FOR ANY ACTIONS, CLAIMS, DEMANDS, OR DAMAGES ARISING FROM YOUR USE OF DATA PROVIDED BY THE SERVICE, INCLUDING BUT NOT LIMITED TO CLAIMS BY THIRD PARTIES (SUCH AS YOUR CUSTOMERS) BASED ON DECISIONS YOU MADE USING OUR DATA.
f) FORCE MAJEURE
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet or telecommunications failures, or third-party service provider outages.
12. Indemnification
You agree to indemnify and hold harmless ServiceCall Inc. from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
13. Termination
Either party may terminate at any time:
- You may cancel your subscription through your account settings
- We may terminate for violation of these Terms
- Upon termination, your right to use the Service ceases
- Certain provisions survive termination (indemnification, limitation of liability, etc.)
Data After Termination
- Your data is retained for 30 days after cancellation
- You may request immediate data deletion by contacting support
- After 30 days, all data is permanently deleted
14. Data Security
We implement industry-standard security measures to protect your data:
- 256-bit SSL encryption for all data transmission
- Encryption at rest for stored data
- Industry-standard security controls and practices
- Security incident response within 24 hours
- Data breach notification within 72 hours if your data is affected
While we implement robust security measures, no system is completely secure. You acknowledge that you use the Service at your own risk.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
16. Dispute Resolution
Any disputes shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
18. Changes to Terms
We may update these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
